Participant Terms and Conditions

The short version

This summary is here to help you understand the main terms. It does not replace the full Terms and Conditions below, which form the legal agreement between you and Swim London when you enter.

You must be aged 18 or over on the day of the Event.
You must be medically fit, properly prepared and capable of safely completing the 5km or 10km distance you enter.
Open-water swimming in the tidal Thames involves inherent risks, even when reasonable safety precautions are in place.
You must follow the instructions of the Event Team. Immediate safety decisions made during the Event are final for operational purposes.
Your entry is non-refundable if you simply change your mind or can no longer attend.
You may transfer your place to another eligible participant or defer to the next equivalent Event until 23:59 UK time on 24 August 2026.
Start times may change because of the tide. You must check the final information sent to you before travelling.
The advertised routes remain subject to final permissions, river conditions and operational requirements.
Swim London may alter, shorten, postpone, relocate or cancel the Event where reasonably necessary.
If Swim London cancels your Event before it begins, or makes a material change before it begins, you will normally be offered a transfer, deferral or refund.
Swim London will arrange public liability insurance for the Event, but this does not provide you with personal accident, medical, cancellation or travel cover.
Nothing in these Terms removes your statutory rights or excludes liability for death or personal injury caused by negligence.

Full Participant Terms and Conditions

Thank you for entering Swim London.

These Terms and Conditions apply to your registration for and participation in the Swim London event identified in your booking confirmation.

The Event is expected to include:

a 10km open-water swim from Brentford to Putney; and
a 5km open-water swim from Barnes to Putney.

The precise routes, distances, start locations and finish locations remain subject to final permissions, tidal and river conditions, water quality, safety assessments and operational requirements.

By purchasing, receiving or accepting an entry, you agree to these Terms and Conditions.

1. About Swim London and the Event

The Event is organised and promoted by Swim London 10K Limited, a company registered in England and Wales under company number 17312082, whose registered office is:

In these Terms, “Swim London”, “we”, “us” and “our” mean Swim London 10K Limited.

Swim London is a commercial limited company. Your entry fee is a payment for the right to participate in the Event and is not a charitable donation.

Any separate, voluntary donation or fundraising contribution will be treated separately from your entry fee and may be subject to additional terms.

Your booking is made with Swim London, even where your registration or payment is processed through an appointed registration or payment platform.

Swim London appoints specialist suppliers and contractors to assist with areas including:

registration;
payment processing;
event management;
course operations;
water safety and rescue;
medical and first-aid provision;
timing and results;
equipment and logistics;
photography and filming; and
liaison with river and public authorities.

Swim London, its appointed contractors, water-safety providers, medical providers, event officials and authorised volunteers are referred to collectively in these Terms as the Event Team.

The Event is dependent on permissions and requirements imposed by relevant authorities, which may include the Port of London Authority, local authorities, emergency services, landowners and other river stakeholders.

2. The contract between you and Swim London

The contract between you and Swim London is formed when:

your completed registration is accepted;
the required entry payment has been received; and
you receive confirmation of your entry.

Your booking confirmation and any important information presented to you during registration form part of the contract.

You should save a copy of:

these Terms;
your booking confirmation;
the event information shown at the time of purchase; and
any subsequent material updates sent to you.

If another person purchases an entry on your behalf, you must still personally satisfy the entry requirements and accept these Terms before participating.

3. Entry eligibility

Your entry is personal to you.

You must not sell, exchange, give away or transfer your entry except through the official transfer process approved by Swim London.

By entering, you confirm that:

you will be aged 18 or over on the day of the Event;
the information you provide during registration is complete and accurate;
you are capable of completing the distance you have entered in open-water conditions;
you have sufficient experience of open-water swimming;
you are capable of swimming safely in proximity to other swimmers;
the distance and expected pace you select are appropriate for your ability;
you can complete your distance within any published cut-off times;
you will comply with any qualification or evidence-of-ability requirement; and
you will tell Swim London if any information relevant to your eligibility changes.

The minimum age of 18 applies to both the 5km and 10km distances.

Swim London may ask you to provide reasonable evidence of your swimming experience, previous results, training or ability to complete your chosen distance.

Swim London may move you to a different wave where reasonably necessary for safety, capacity or effective event operation.

We may refuse or cancel an entry where we reasonably believe that:

the entry criteria have not been met;
materially inaccurate or misleading information has been provided;
the entry was obtained fraudulently;
an unauthorised transfer or resale has taken place; or
allowing the person to participate would create an unacceptable safety risk.

Where we cancel your entry because you provided materially inaccurate information, did not meet clearly published eligibility requirements or breached these Terms, you will not normally be entitled to a refund.

Where Swim London introduces a new material eligibility requirement after you enter and you cannot reasonably comply with it, you will be entitled to transfer, defer or cancel your entry and receive a refund.

4. Accessibility and reasonable adjustments

Swim London aims to operate an inclusive event.

You should contact us as early as reasonably possible if you have a disability, medical condition or accessibility requirement that may affect:

registration;
event communications;
arrival or check-in;
access to event facilities;
the safety briefing;
entry into or exit from the water; or
your participation in the swim.

We will consider reasonable adjustments in consultation with you and, where appropriate, our operational, medical and water-safety providers.

An adjustment may not be possible where it would:

create an unacceptable risk to you or another person;
fundamentally change the nature of the Event;
conflict with a requirement imposed by an authority; or
place a disproportionate operational burden on the Event.

Any decision will be made reasonably and on the basis of the circumstances of the individual request.

5. Your health and fitness

By taking part, you confirm that:

you are medically and physically fit to participate;
you are properly prepared for your chosen distance;
you have disclosed any relevant medical condition, disability, allergy, medication or other information that could reasonably affect your safe participation;
you will keep your medical and emergency-contact information accurate and up to date;
you will not participate if you feel unwell or believe that doing so could place you or another person at unreasonable risk; and
you will withdraw if your health or physical condition makes continued participation unsafe.

Long-distance swimming in cold, open or moving water can place significant strain on the body.

You should obtain advice from a suitably qualified medical professional before entering or participating if you:

have a heart or respiratory condition;
have a history of seizures, blackouts or loss of consciousness;
have experienced cold-water shock or hypothermia;
have a condition affected by prolonged physical exertion or cold water;
are taking medication that may affect your ability to participate safely; or
are uncertain about your fitness to take part.

Providing medical information to Swim London or the Event Team does not amount to medical advice or confirmation that you are fit to participate.

The Event Team may prevent you from starting or continuing where it reasonably believes that participation would present an unacceptable safety risk.

Health information will be handled in accordance with Swim London’s Privacy Policy and the medical-information wording presented during registration.

6. Preparation and equipment

You are responsible for arriving properly trained, equipped and prepared.

You must comply with all equipment requirements communicated before the Event. These may include requirements relating to:

the official swim cap;
a timing chip or tracking device;
a tow float or other visibility equipment;
wetsuits;
non-wetsuit participation;
goggles;
identification;
footwear for access areas; and
warm clothing for after the swim.

Any wetsuit, tow float or other personal equipment must:

be suitable for open-water swimming;
fit correctly;
be in safe working condition; and
comply with the published Event rules.

You must not use fins, hand paddles, snorkels, headphones, personal flotation devices or other equipment unless Swim London has expressly permitted their use.

Swim London may inspect equipment and may prevent you from starting or continuing where required equipment is missing, unsuitable, altered or unsafe.

Failure to bring or use mandatory equipment will not normally entitle you to a refund.

7. Safety instructions

Your safety and the safety of others depend on participants following the Event’s safety arrangements.

You agree to:

attend any compulsory safety briefing;
follow all reasonable instructions given by the Event Team;
enter and exit the water only at authorised locations;
remain within the marked or instructed course;
follow the rules relating to overtaking, feeding and assistance;
make yourself known to the safety team if you are in difficulty;
use the withdrawal signal explained at the briefing;
leave the water immediately when instructed;
return any timing or tracking equipment when requested; and
report to the designated Event Team member after finishing or withdrawing.

The Event Team may prevent you from starting or remove you from the water where it reasonably considers this necessary because of:

your health or apparent condition;
your pace or location;
missed cut-off times;
unsafe or disruptive behaviour;
unsuitable or missing equipment;
failure to follow instructions;
a change in river or weather conditions; or
the safety of you, another participant or another river user.

Immediate safety decisions made during the Event are final for operational purposes. You may still raise a complaint after the Event, and this does not affect your statutory rights.

8. Inherent risks of participation

You understand that open-water swimming in a tidal river is a physically demanding activity involving risks that cannot be completely removed, even where reasonable safety precautions are taken.

These risks may include:

cold-water shock;
hypothermia or overheating;
strong currents and changing tides;
waves, wash and changing river conditions;
reduced visibility;
collision with other swimmers, safety craft, river craft or objects;
contact with natural or man-made hazards;
water quality and waterborne illness;
fatigue, cramp and breathing difficulties;
panic or disorientation;
injury during entry into or exit from the water;
the aggravation of an existing medical condition;
drowning;
serious injury; and
death in the most extreme circumstances.

You voluntarily accept the inherent risks of participating that remain after reasonable safety measures have been taken.

You remain responsible for making an honest assessment of your fitness, experience and ability and for following all safety instructions.

Nothing in this clause excludes or limits responsibility for negligence or otherwise removes any right that cannot legally be excluded.

9. Event permissions, river conditions and water quality

The Event takes place in a working, natural tidal river.

The advertised routes remain subject to:

final approval and permissions;
navigation requirements;
tidal conditions;
weather;
river flow;
water quality;
emergency-service advice;
land access;
the availability of safety resources; and
other operational requirements.

Swim London will consider available water-quality information, relevant professional advice and any testing undertaken or commissioned for the Event.

Because conditions in a natural tidal river can change, Swim London cannot guarantee the water quality or condition of the river at any particular moment.

A decision to proceed, alter, delay or cancel the Event will be made reasonably, taking account of the available information and the advice or requirements of the relevant authorities and specialist providers.

9A. Illness following participation

Swimming in a natural tidal river carries an inherent risk of exposure to bacteria, viruses, pollutants and other substances that may cause illness. Symptoms may arise during the Event or in the hours or days following participation.

Swim London cannot guarantee that the river water will be free from potentially harmful organisms, pollution or contaminants at the time of the Event. Water quality can vary over short periods and may be affected by rainfall, river flow, tides, discharges and other circumstances outside Swim London’s control.

Swim London will take reasonable steps to assess the available water-quality information and relevant professional or regulatory advice before deciding whether the Event should proceed, be changed, postponed or cancelled.

Subject to the liabilities that cannot legally be excluded, Swim London will not be responsible for illness arising solely from the inherent water-quality risks of swimming in a natural tidal river, or from conditions that could not reasonably have been identified or avoided despite Swim London exercising reasonable care and skill.

Nothing in this clause excludes or limits liability where illness, injury or loss is caused by:

Swim London’s negligence;
a failure by Swim London to exercise reasonable care and skill;
Swim London’s failure to act reasonably on information available to it;
a misleading statement or material omission by Swim London; or
any other matter for which liability cannot legally be excluded or limited.

Participants who experience symptoms following the Event should obtain appropriate medical advice and notify Swim London where they reasonably believe that their illness may be connected with participation in the Event.

10. Entry prices and additional charges

All compulsory entry charges will be displayed before you complete your booking.

The total price shown before payment will include any compulsory booking or administration fee collected by Swim London or on Swim London’s behalf.

Optional products, donations or services will be clearly identified and will not be added without your agreement.

You are responsible for checking the entry, distance, participant details and price before completing payment.

11. Participant cancellations and refunds

Your entry relates to a leisure activity taking place on a specified date. The ordinary statutory 14-day cancellation period does not apply to the Event.

Unless these Terms state otherwise, your entry fee is non-refundable if:

you change your mind;
you can no longer attend;
your personal circumstances change;
you become injured or unwell;
your travel is disrupted;
you fail to complete registration requirements;
you arrive late;
you miss your check-in or start time;
you withdraw before or during the Event; or
you do not complete the Event.

This is why we recommend considering appropriate personal accident, cancellation and travel insurance.

We may consider exceptional circumstances at our discretion, but doing so in one case does not require us to make the same decision in another case where the circumstances differ.

Nothing in this clause affects your statutory rights, including where Swim London is in breach of contract.

12. Transfers and deferrals

You may transfer your entry to another eligible person or defer it to the next equivalent Swim London event through the official entry-management process.

The deadline for transfers and deferrals is:

23:59 UK time on 24 August 2026.

A transfer or deferral is not complete until:

the official process has been followed;
all required information has been supplied;
the replacement participant has accepted the applicable terms;
any applicable administration fee has been paid; and
confirmation has been issued.

Any administration fee will be clearly shown before the transfer or deferral is confirmed.

A replacement participant must meet all eligibility, medical, experience and equipment requirements.

You must not:

sell an entry for more than the amount originally paid;
advertise or transfer an entry through an unauthorised resale channel;
allow another person to participate using your identity; or
alter or falsify registration information.

After the deadline, we may be unable to process changes because final participant information will have been supplied to safety, timing, registration and public-authority partners.

13. Changes to the Event

Swim London may make reasonable changes where necessary for participant safety or effective event delivery.

Operational changes may include:

changing start or wave times;
changing wave allocations;
changing the running order;
adjusting cut-off times;
changing entry or exit arrangements;
altering feeding arrangements;
making limited changes to the course; or
changing event facilities or suppliers.

A limited operational change will not normally entitle you to a refund.

Swim London may also delay, suspend, shorten, re-route, postpone, relocate or cancel all or part of the Event where reasonably necessary because of:

safety concerns;
an emergency or major incident;
adverse weather;
tides, river flow or river conditions;
water quality;
instructions from an authority or emergency service;
the loss or withdrawal of a required permission;
obstruction or closure of part of the route;
the unavailability of essential safety or operational resources;
industrial action;
terrorism or a credible security threat;
public-health requirements; or
another circumstance outside Swim London’s reasonable control.

We will communicate material changes as soon as reasonably practicable using the contact information provided during registration.

14. Material changes, postponement and cancellation by Swim London

A change will be treated as material where it significantly changes the essential nature of the entry you purchased.

Examples may include:

moving the Event to another date;
moving your swim to a substantially different location or type of venue;
cancelling the distance you entered;
substantially reducing your distance before it starts; or
making another change that means the Event is no longer materially equivalent to the entry originally purchased.

A reasonable change to a start time, wave, running order, cut-off time or limited section of the route will not normally be a material change.

If Swim London makes a material change before your Event begins, you will be offered a reasonable choice between:

accepting the changed Event;
transferring your entry to the next equivalent Swim London event;
deferring your entry where an equivalent event is available; or
receiving a refund of the entry price paid, including any compulsory booking fee collected by Swim London or on its behalf.

If Swim London cancels your Event before it begins and does not provide a materially equivalent Event on the same date, you will be offered:

a transfer or deferral to the next equivalent Swim London event; or
a refund of the entry price paid, including any compulsory booking fee collected by Swim London or on its behalf.

You will not be required to accept a transfer, voucher or deferral instead of a refund where you are legally entitled to a refund.

If the Event is suspended, shortened, re-routed or abandoned after your distance has started, there will not automatically be a full refund.

In those circumstances, Swim London will act reasonably and consider:

the reason for the decision;
the stage at which the decision was made;
the proportion of the Event and associated services already delivered;
any alternative arrangements offered;
the circumstances outside Swim London’s control; and
your statutory rights.

This clause does not limit any refund or other remedy to which you are entitled under consumer law.

15. Start times, waves and timing

Start times and wave allocations are affected by tidal, navigation, safety and operational requirements.

Published provisional times may change, including at short notice.

You are responsible for:

providing a working email address and telephone number;
checking communications from Swim London;
checking final event information before travelling;
arriving by the published registration time; and
being ready for your allocated start.

Swim London will take reasonable steps to communicate significant changes but is not responsible for a participant failing to read information correctly sent to the contact details provided.

Missing check-in or your start time will not normally entitle you to a refund.

Timing and results are provided as part of the Event service. Although reasonable efforts will be made to provide accurate results, technical failures, missed detections and human errors can occur.

Where possible, we will investigate credible timing queries and correct verified errors. We do not guarantee that every participant will receive a complete or error-free official time.

16. Withdrawal and removal during the Event

You may withdraw at any time.

If you wish to withdraw while in the water, you must:

use the withdrawal signal explained during the safety briefing;
follow the instructions of the water-safety team;
board a safety craft or leave the water when directed; and
report to the designated Event Team member before leaving the event area.

You do not need to be experiencing a medical emergency to be removed from the water.

The Event Team may remove you as a precaution because of concerns about:

your condition;
your pace;
your location;
your behaviour;
your equipment;
your ability to meet a cut-off;
changing conditions; or
your ability to complete the course safely.

If you leave the Event without properly reporting your withdrawal, the Event Team may begin an unnecessary search or emergency response.

You may be responsible for reasonable costs directly caused by deliberately failing to report your safe withdrawal, where it is lawful and reasonable to recover them.

17. Participant conduct

Swim London is intended to be safe, inclusive and enjoyable.

You must behave respectfully towards:

other participants;
Event Team members;
volunteers;
contractors;
spectators;
local residents;
landowners;
authorities; and
other river users.

You must not behave in a way that is:

unsafe or reckless;
abusive, threatening or violent;
discriminatory or harassing;
dishonest or fraudulent;
likely to interfere with Event operations;
damaging to property or the environment; or
likely to endanger or seriously disrupt another person.

Swim London may refuse participation or remove a person whose conduct breaches this clause.

Serious incidents may be reported to the police, the Port of London Authority, another relevant authority or a safeguarding body.

You will not normally receive a refund if you are removed because of your conduct or a serious breach of these Terms.

18. Photography, filming and media

Photography, video and audio recording may take place during the Event.

General event imagery may be used by Swim London for:

event reporting;
news and editorial coverage;
the Swim London website;
Swim London social-media channels;
promotion of future Swim London events;
event archives;
public relations; and
reporting to event partners and sponsors.

Because the Event takes place in public areas and involves groups of participants, we cannot guarantee that you will not appear incidentally in general event footage.

Where reasonably possible, Swim London will consider a request not to use an image in which you are the principal and clearly identifiable subject, particularly where you have a serious privacy, security or safeguarding concern.

You should contact Swim London before the Event and notify the registration team when you arrive if you have such a concern.

A separate release or other appropriate permission will normally be obtained before:

using you as the principal subject of a commercial advertising campaign;
recording a featured interview or testimonial;
creating an individual participant case study; or
licensing a prominently identifiable image of you to a sponsor for the sponsor’s own unrelated advertising.

Photographers and videographers must obtain prior permission before using the Event for unauthorised commercial purposes.

19. Personal information and data protection

Swim London uses personal information to:

administer entries;
verify eligibility;
process payments;
send event information;
plan and safely deliver the Event;
provide timing and results;
manage transfers and refunds;
respond to incidents and emergencies;
deal with complaints;
satisfy insurance requirements; and
comply with legal and regulatory obligations.

Relevant information may be shared with appointed registration, payment, timing, water-safety, medical, event-management and technology providers and with relevant public authorities.

Medical and health information will only be available to people who reasonably require it for:

participant assessment;
event safety;
accessibility arrangements;
medical support;
emergency response;
incident investigation;
insurance; or
legal compliance.

Where necessary in an emergency, relevant personal and medical information may be shared to protect you or another person from serious harm.

You are responsible for keeping your personal, medical and emergency-contact information accurate and up to date.

Acceptance of these Terms is separate from any optional consent to receive marketing communications.

20. First aid and medical treatment

If you become ill or injured, you authorise the Event Team to arrange reasonable:

rescue assistance;
first aid;
medical assessment;
emergency treatment; and
transport to a medical facility.

Medical decisions will be made by the relevant qualified healthcare or emergency personnel in accordance with their professional responsibilities.

Where appropriate, the Event Team will make reasonable efforts to contact your nominated emergency contact.

Swim London cannot guarantee that your emergency contact will be reached immediately.

You remain responsible for personal costs not covered by the NHS, your insurer or another applicable arrangement, to the extent that those costs may lawfully be charged to you.

21. Personal belongings

You are responsible for your own clothing, equipment and belongings.

Where Swim London provides a bag-drop, bag-transfer or storage service:

you must follow the published instructions;
bags must be clearly labelled where required;
prohibited items must not be deposited;
collection may require proof of identity or a matching participant number; and
items are left at your own risk, subject to Swim London’s legal responsibilities.

You should not place cash, jewellery, electronics, important documents, medication required during the Event or other high-value or fragile items into event baggage.

Swim London will not be responsible for loss, theft or damage unless caused by a failure to exercise reasonable care and skill or where responsibility cannot legally be excluded.

22. Event equipment

Any timing chip, tracker, identification item or other reusable equipment supplied to you remains the property of Swim London or the relevant supplier unless you are told otherwise.

You must:

use the equipment in accordance with instructions;
not alter, damage or obscure it;
not give it to another person;
report any fault or loss promptly; and
return reusable equipment when requested.

You may be charged the reasonable replacement cost of reusable equipment that you deliberately or negligently fail to return.

Any replacement charge will reflect the reasonable cost of replacing the missing equipment and will not be used as a penalty.

23. Insurance

Swim London will arrange public liability insurance for the Event appropriate to its activities and any applicable permit or contractual requirements.

Public liability insurance is intended to cover certain liabilities of the organiser. It is not personal insurance for each participant and does not necessarily compensate you for every injury, loss or expense.

You are responsible for deciding whether to arrange your own:

personal accident insurance;
medical insurance;
event-cancellation insurance;
equipment insurance; and
travel insurance.

We recommend checking that any personal policy covers participation in a long-distance open-water swimming event in the tidal Thames.

24. Swim London’s responsibility to you

Swim London will organise and administer the Event with reasonable care and skill.

Swim London may appoint appropriately experienced contractors and specialist providers to deliver parts of the Event. The appointment of a contractor does not remove or reduce any legal responsibility that Swim London owes to you.

Nothing in these Terms excludes or limits liability for:

death or personal injury caused by negligence;
fraud or fraudulent misrepresentation;
breach of your statutory consumer rights; or
any other liability that cannot legally be excluded or limited.

Subject to those protections, Swim London will not be responsible for a loss that:

was not a reasonably foreseeable result of Swim London’s breach;
arose because you failed to follow these Terms or reasonable safety instructions;
arose because you provided inaccurate or incomplete information;
arose from an inherent risk of the activity that remained despite reasonable safety precautions;
was caused solely by an event outside Swim London’s reasonable control and not by a failure by Swim London to exercise reasonable care and skill; or
relates to a business, trade or professional activity, because entries are supplied for personal and recreational participation.

Nothing in these Terms requires you to pursue an Event contractor instead of Swim London where Swim London is legally responsible to you.

25. Your responsibility

You are responsible for losses or damage that you deliberately cause or that arise from your negligent or reckless conduct.

This may include reasonable losses arising from:

deliberately damaging Event equipment or property;
participating under another person’s identity;
deliberately providing false information;
knowingly breaching a safety exclusion;
interfering with rescue or event operations; or
deliberately failing to report that you have safely withdrawn.

Swim London will take reasonable steps to reduce any recoverable loss and will not seek to impose a penalty that is disproportionate to the actual circumstances.

26. Changes to these Terms

The Terms applying to your booking are the version presented to you when your entry is accepted.

Swim London may make a reasonable change after booking where necessary to:

comply with a change in law;
comply with an instruction from a relevant authority;
address a safety or operational issue that was not reasonably foreseeable when entries opened;
correct an obvious error;
clarify wording without changing its effect; or
make a change that benefits participants and does not materially disadvantage them.

Swim London will not use this clause to remove or materially reduce your statutory rights.

A significant change will be communicated directly to affected participants.

Where a change materially alters the essential nature of the Event or the entry purchased, the options in clause 14 will apply.

27. Complaints

We want to resolve complaints quickly and fairly.

A complaint should be sent to:

Please include:

your name;
your booking or participant number;
the nature of the complaint;
relevant dates and details;
any supporting evidence; and
the outcome you are seeking.

We will acknowledge and consider your complaint within a reasonable period.

If we cannot resolve the complaint directly, we will provide information about any applicable accredited alternative dispute resolution provider where appropriate and will state whether Swim London is willing or required to participate in that process.

Nothing in this clause prevents you from seeking independent advice or exercising your legal rights.

28. Governing law and courts

These Terms are governed by the laws of England and Wales.

If you live in England or Wales, the courts of England and Wales will have jurisdiction.

If you live in Scotland or Northern Ireland, applicable consumer law may allow you to bring proceedings in the courts of the part of the United Kingdom where you live.

Nothing in this clause removes any protection given to you by mandatory consumer law.

29. General provisions

If any part of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.

If Swim London does not immediately enforce a provision, this does not mean that it has permanently waived the right to enforce it.

Nothing in these Terms creates an employment, partnership, agency or joint-venture relationship between you and Swim London.

Except where legislation provides otherwise, no person who is not a party to the contract between you and Swim London may enforce these Terms.
